Terms of sale
These General Terms and Conditions of Sale (GTC) govern sales made on the Luxapod website (hereinafter referred to as "the Site").
Scope
These GTC apply to all sales of products made on the Site between the Seller and its Customers.
Products
The products offered for sale on the Site are described accurately and comprehensively. Product photographs are non-contractual.
Prices
Product prices are indicated in euros, inclusive of all taxes (VAT included). They may be modified at any time by the Seller, but the prices applied are those in effect at the time the order is confirmed.
Order
The Customer selects the products they wish to order and confirms their order by clicking the "Confirm Order" button. If the Customer only provides a billing address at the time of ordering, it will be used as the default delivery address. The Customer is informed of this default use before confirming the order and may modify it if necessary. This confirmation implies unconditional acceptance of these GTC. An order confirmation email is sent to the Customer as soon as the order is validated.
Payment
Orders are paid by credit card, PayPal, or any other payment method accepted by the Site. Payment is due immediately upon ordering. The transaction is secured and the Customer's banking details are encrypted.
Delivery
Products are delivered to the address provided by the Customer at the time of ordering (billing address used as delivery address if no other address is specified). Delivery times and costs are specified during the order process. The Seller undertakes to do everything possible to meet these deadlines but cannot be held responsible for any delays attributable to the carrier.
The Customer is solely responsible for the delivery information provided at the time of ordering, including the address, name, and contact details.
In the event of an error or incomplete address resulting in a failed delivery, the Seller cannot be held responsible. If the parcel is returned to the Seller, reshipping costs will be borne by the Customer.
No address modification can be guaranteed after the order has been confirmed and shipped.
No refund can be made until the parcel has been returned to the Seller. Initial shipping costs are non-refundable.
Right of Withdrawal
In accordance with applicable legislation, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal, without having to justify any reason or pay any penalty, with the exception of return costs which remain the Customer's responsibility.
Warranty
Products sold on the Site benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with applicable legislation.
Liability
The Seller cannot be held liable for direct or indirect damages resulting from the use of the Site or the inability to use it, except in the case of proven fault on their part.
Personal Data
Personal data collected during the order process is handled in compliance with applicable regulations. The Customer has the right to access, rectify, and delete their personal data.
Applicable Law and Disputes
These GTC are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent courts will be referred to.
Modification of the GTC
The Seller reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.
